You also agree that in case of loss of package or any non-delivery thereof, Giftingyard.com shall not be responsible for any subsequent loss of your data and material, or misuse of your data and material by any third party.
You further agree that you shall not use the Website for any infringement of any intellectual property rights, criminal activity, or for any other violation of the law. Giftingyard.com shall not be held liable for any such infringement, criminal activity, or any other violation of the law.
In case of products or experiences, there may be a slight variation from the picture/video shown. We shall, however, ensure our best to keep it as close to the photograph/description as possible.
The product specifications (weight, size, colour etc.) mentioned with the product photos is only approximate. There may, hence, be a variation in the pictures and the respective products.
The product/services provided on this website are without warranties of any kind either expressed or implied and Giftingyard.com disclaims all or any of them to the fullest extent. Giftingyard.com does not warrant that the products/services offered will be error-free, or that the defects will be corrected, or that this website or the server that makes it available are or will be free of viruses or other harmful components.
Giftingyard.com will not be responsible for any damage suffered by users from use of the services on Giftingyard.com. This without limitation includes loss of revenue or data resulting from delays, non-deliveries, missed deliveries, or service interruptions as may occur because of any act / omission of the vendor. This disclaimer of liability also applies to any damages or injury caused by any failure of performance, negligence, defect, deletion, error, omission, interruption, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, tortuous behaviour, or under any other cause of action.
Modifications:
Giftingyard.com may revise and update these Terms of Use at any time at its sole discretion. Your continued usage of the Website after any changes to these Terms of Use will be deemed as acceptance of the said changes. Any aspect of the Website may be changed, supplemented, deleted or updated without notice, at the sole discretion of Giftingyard.com. Giftingyard.com may also change or impose fees for products and services provided through the Website at any time, at its sole discretion. You are responsible for regularly reviewing the Terms of Use.
Request for cancellations of orders once placed on Giftingyard.com shall not be entertained once it’s processed.
General Scenario:
In case we receive a cancellation e-mail and till the time the order has already been “processed” by us, the order cannot be cancelled. Giftingyard.com has the complete right to decide whether an order should be cancelled or not. Also, the customer agrees not to dispute the decision made by Giftingyard.com and accept Giftingyard.com decision regarding the cancellation.
Cases of goods unavailability or service problems:
If the order is confirmed by us and Giftingyard.com is not able to ship the product then we give a refund to the customer, if the customer demands 100% refund will be given. If a product is not available or the vendor is not able to ship the product.
If the item sent for replacement is not available, we will try to give you the best possible alternative, but in the end choice of customer will be final.
For courier products, if the delivery address is outside the service area, then only a 100% refund will be given
Giftingyard.com reserves the right to refuse or cancel any order placed for a product that is listed at an incorrect price or for any other reason. This shall be regardless of whether the order has been confirmed and/or payment been received. The payment shall be refunded and the User shall be informed of the same.
If a non-delivery or late delivery occurs due to a mistake by the User (i.e. wrong or incomplete name or address or recipient not available) any extra cost spent by Giftingyard.com for re-delivery shall be claimed from the User placing the order.
The User agrees to give accurate, authentic and true information. Giftingyard.com reserves the right to confirm and validate the information and other details provided by the User at any point of time. If any such User details are found not to be true wholly or partly, Giftingyard.com has the right in its sole discretion to reject the registration and debar the User from using the services of Giftingyard.com without prior intimation whatsoever.
Giftingyard.com will not be liable for any type or kind of credit card fraud. The liability to use a card fraudulently will be on the user and the onus to ‘prove otherwise’ shall be exclusively on the user. The User must exclusively use his/her own card on the website.
Giftingyard.com shall not entertain any complaints after 7 days, once the order is delivered.
Giftingyard.com further reserves the right to investigate complaints or reported violations of the Terms of Use and to take any action it deems fit, including but not limited to reporting any suspected unlawful activity to government authorities, police, regulators, or other third parties and disclosing any information to such persons or entities in connection with e-mail addresses, usage and purchase history, IP addresses and traffic information.
While we always try 100% to ensure deliveries on time, there could be delays due to weather, calamities and other unavoidable reasons that are beyond our control. In such cases, your product will be delivered at the earliest.
Use of client images:
Images of clients shared by our partners/vendors may be used for marketing under the implied understanding that the clients have voluntarily allowed the photographs/videos to be taken. In case of objections, the images will be removed immediately.

Returns, Refunds, and Exchanges:
Please note that in case of returns and refunds, all products must be in unused condition with all labels and packing intact. Exchanges are available only on specified products. The terms and conditions for specific categories of product are as below:
Customized Items:
- Returns are not available for customized products due to their personalized nature.
Damaged Customized Items:
- In the rare event of receiving a damage customized item, contact our customer service support@giftingyard.com within 24 hours.
- Video evidence during unboxing is essential for damaged item claims.
Once your claim is received, reviewed and accepted on a preliminary basis by Giftingyard.com, Giftingyard.com shall arrange for a reverse pick-up for the same at no extra charges. In case your pin code is not eligible for a reverse pick-up facility, you may have to self-ship the product, after confirmation from Giftingyard.com, to its office at Giftingyard, 27L Ground Floor, Kustia Road Kolkata, West Bengal-700039. Giftingyard.com will credit you with a Rs. 60/- coupon code in your Gmail ID account in lieu of any shipping costs incurred by you. For best service network, you may use IndiaPost.
Damaged Non-Customized items:
Video evidence during unboxing is essential for damaged item claims. In case the product received is damaged, or different from the one ordered, please write to us at support@giftingyard.com within 24 hours of receiving the product along with the pictures of the defect. No claims/complaints made after 24 hours post receipt shall be entertained. Once your claim is received, reviewed and accepted on a preliminary basis by Giftingyard.com, Giftingyard.com shall arrange for a reverse pick-up for the same. In case your pin code is not eligible for a reverse pick-up facility, you may have to self-ship the product, after confirmation from Giftingyard.com, to its office at Giftingyard, 27L Ground Floor, Kustia Road Kolkata, West Bengal-700039. Giftingyard.com will credit you with a Rs. 60/- coupon in your Gmail ID account in lieu of any shipping costs incurred by you for best service network, you may use IndiaPost.
Once the returned products are received back, they will be checked. Upon satisfaction, Giftingyard.com will issue credits in the form of a coupon code or a refund to the original mode of payment. This process will take 7-15 working days (Sundays and Public Holidays are not included) from the date of raising the return request.
General conditions of return for non-customized items:
Incomplete order/Product missing: If you did not receive a product in your package or find that the product is missing, please write to the customer support team support@giftingyard.com with your order number within 24 hours of receiving the shipment. No claims/complaints made after 24 hours post receipt shall be entertained. Upon investigation and acceptance of your claim, Giftingyard.com will dispatch a new product or provide you with a coupon code or refund to the original mode of payment (as preferred by you). Any claims made after 24 hours shall not be accepted.
Package status is RTO or Return to origin:
In case the package is returned to Origin, please write to us at support@giftingyard.com with your order number. In case the return is made without any delivery attempt, Giftingyard.com will reship your goods at no added cost.
In case the package is returned to origin due to incomplete address / wrong contact number/ customer out of town / incorrect pin code, Giftingyard.com provides the option of a reshipment at an additional shipping cost of Rs. 60/- in order to reship the goods, to the same or an alternate address. In case you do not wish to reship your package, a refund would be made to your original payment method after the deduction of Rs.100/- as shipping charges for both forward shipping and reverse shipping. Please note refunds are not applicable on customised products: you will have to pay for reshipping in such case as these products are made to order.
Intellectual Property:
Any and all intellectual property rights associated with the Website and its contents as made available by Giftingyard.com are the sole property of Giftingyard.com. You may not copy, imitate, reproduce, modify, amend, lease, loan, sell and/or create derivative works from, upload, transmit, and/or distribute any of the contents of the Website in any form or manner without the prior permission of Giftingyard.com.
By uploading content to or submitting any materials for use on the Website, you grant (or warrant that the owner of such rights has expressly granted) Giftingyard.com a perpetual, royalty-free, irrevocable, non-exclusive right and license to use.
Termination:
You agree that Giftingyard.com, at its sole discretion, may terminate or suspend your use of the Website, at any time and for any or no reason at its sole discretion, even if access and use continue to be allowed to others. You agree that Giftingyard.com shall not be liable to you or to any third party for any termination or suspension of your access to the Website.
Giftingyard.com reserves its right to initiate proceedings in accordance with the law against any direct or indirect attack on Giftingyard.com, its owners, employees or third-party contractors and freelancers.
Limitation of Liability:
Giftingyard.com shall not be responsible for any injury, death, loss, loss of liability, claims, or damage of any kind arising out of your use of the website (Giftingyard.com) and its product. Giftingyard.com shall not be responsible for any direct, indirect, incidental, punitive, exemplary or any other form of damages that is caused by (or connected with) your use of, or your inability to use, this Website on any basis whatsoever. Your remedies are limited to those provided herein to the degree that such limitations are permitted by the law.
Governing law and jurisdiction:
These Terms of Use are governed by the laws of India and are subject to the exclusive jurisdiction of the courts in Kolkata, West Bengal India.

By agreeing to these Terms of Service, you agree to the Privacy Policy and Shipping Policy of Giftingyard.com (https://Giftingyard.com/privacy-policy/ and https://Giftingyard.com/shipping-policy/) by incorporation hereto, and consent to the continuous use and processing of Personal Data by Giftingyard.com for the purposes specified therein. Giftingyard.com is not responsible for any compromise of Personal Data caused by breach of the Website or otherwise.
You may not assign these Terms and Conditions or any of your interests, rights or obligations under these Terms and Conditions. If any provision of these Terms and Conditions shall be found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect. No waiver of any of these Terms and Conditions shall be deemed a further or continuing waiver of such term or condition or any other term or condition. You waive any other requirement for these Terms and Conditions to be proved by means of a written document.
